URGENT: Stop Congress from Voiding State Humane Cosmetics Acts

Humane Cosmetics ActUrgent action is needed! The U.S. Senate is quickly advancing S.4384, the Food and Drug Administration Safety and Landmark Advancements Act (FDASLA), which has an amendment tucked in that would void all state humane cosmetics acts (HCAs) that prohibit the sale, with some exceptions, of animal-tested cosmetics. 

The concerning language is found in “Sec. 614. Preemption.” This provision would prohibit 10 states that have passed HCAs from enforcing their laws and would also prohibit passing future laws pertaining to animal tested cosmetics. 

Passage of Humane Cosmetics Acts reflects shifting consumer priorities, as multiple polls have shown that U.S. consumers support ending animal testing for cosmetics. In fact, a 2015 Nielsen poll found that “not tested on animals” was the most important consumer packaging claim for respondents. 

Consumers and animal advocates have fought hard for the state HCAs that are in place. With a single provision, the Senate would remove years of progress on this issue and open the door for unnecessary, painful animal testing in the name of vanity to continue. Join NAVS as we call upon the U.S. Senate to remove Sec. 614 before bringing FDASLA up for a final vote.

Please oppose Sec. 614 of S.4348

Dear [Decision Maker],

I am writing to ask that you oppose the inclusion of Sec. 614 in S.4348, the Food and Drug Administration Safety and Landmark Advancement Act. This provision would ultimately void state humane cosmetics acts (HCAs) in 10 states that ban, with some exceptions, the sale of cosmetics tested on animals. Sec. 614 would further ensure that future bills protecting animals from painful cosmetic testing would be dead in the water.

It is imperative that we continue to advocate for advanced science that better predicts human outcomes. Inclusion of Sec. 614 in the FDASLA serves only to keep us in the terrible cycle of "we have always done it this way." HCAs are popular pieces of legislation that are supported not only by consumers looking to minimize harm to animals, but also by the Personal Care Products Council, a trade organization representing 90% of the U.S. cosmetics industry. There is simply no justification for voiding these popular, humane laws.

Please oppose inclusion of Sec. 614 in the FDASLA. Painful and unnecessary tests on animals in the cosmetics industry need to come to an end.
